Consent and Authorization for Genetic Services

1. Genetic Services and Use of Genomic Data
Mito Health Inc. (“Mito,” “we,” “us,” or “our”) provides direct-to-consumer genetic testing services that allow you to receive your genomic data and educational genomic insights through Mito’s platform (“Genetic Services”), as described in more detail in the Genetic Services Terms.
The Genetic Services are for wellness and educational purposes only, and are not a medical test. The Genetic Services do not diagnose, treat, cure, prevent, or predict disease; determine medication dosing; replace care from a licensed health-care professional; or provide emergency or medical advice. Do not make medical decisions based on the Genetic Services. Consult a qualified health-care professional about medical questions or concerns.
Mito utilizes service providers to assist Mito in rendering the Genetic Services, including accredited laboratories, hosting and storage providers, and a sequencing provider, Genetic Superintelligence Company (operating “The Genome Computer Company”), to compile and analyze your genomic data.
2. Authorization of Genetic Services
By electronically signing this consent, you expressly consent to and authorize Mito to:
- Collect your biological sample (including genetic material), and your identifiable information, including account, order, and shipping information;
- Send your sample and information to our service providers for DNA extraction, processing, and sequencing;
- Generate, sequence, analyze, interpret, maintain, and deliver your genomic data and wellness and educational information;
- Host your genomic data in Mito’s platform and periodically re-annotate or update the wellness or educational information associated with it as scientific resources, annotation, methods, or Genetic Services features change; and
- Use your information only to operate, secure, support, and provide the Genetic Services.
Mito will not sell your genomic data, disclose it to any third parties that are not our service providers, or use your genomic data for marketing, advertising, or to train our AI. 3. Biological-Sample Retention by Laboratory
After testing is completed, the accredited laboratory will retain your biological sample to the extent required for the laboratory’s accreditation, quality-assurance, method-improvement, or legal-compliance obligations. This retention is separate from the testing and processing needed to provide the Genetic Services.
The laboratory will retain the sample only for the minimum period required or permitted by those obligations and its applicable retention procedures. Mito does not authorize use of the retained sample for unrelated research, product development, sale, marketing, AI-model training, or third-party data products.
At checkout you acknowledge: “I acknowledge and expressly consent to the accredited laboratory’s retention of my biological sample (including genomic data) for the limited laboratory-accreditation, quality-assurance, method-improvement, and legal-compliance purposes described above.”
4. Eligibility and Texas Exclusion
The Genetic Services are available only to individuals who are at least 18 years old and who provide only their own biological sample or genetic data. Mito does not provide the Genetic Services to Texas residents or persons located in Texas.
By electronically accepting this consent, you certify that you are at least 18 years old, are providing only your own biological sample or genetic data, and are not a resident of, and are not located in, Texas at the time of your purchase of the Genetic Services.
5. Withdrawal of Consent and Genetic Data Rights
You may revoke consent to this form at any time, or request deletion of your genomic data and destruction of your biological sample, subject to applicable legal, regulatory, or laboratory-retention requirements, by emailing help@mitohealth.com.
Please review the Genomic Data Privacy Notice to understand these rights, including how to submit a request for genomic data deletion or biological-sample destruction. Revocation, deletion, or destruction does not reverse processing completed before Mito receives your request.
6. Acceptance
You hereby represent that you have read and understand this Consent and Authorization for Genetic Services (“Consent”), you understand that you may revoke this Consent and how to provide notice of revocation, and that you voluntarily and knowingly provide your consent herein.
